Welcome to Zenvixas! These Terms of Service (“Terms“) govern your use of our website, mobile apps, and all online services (collectively, the “Zenvixas Services” or “Services“) provided by Zenvixas Inc. (“Zenvixas,” “we,” “our,” or “us”).

SECTION 23 CONTAINS A MANDATORY ARBITRATION CLAUSE THAT AFFECTS YOUR LEGAL RIGHTS. YOU MAY OPT OUT BY FOLLOWING THE INSTRUCTIONS IN THAT SECTION.
By using or accessing the Zenvixas Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Agreement Overview

These Terms are between you (“User”) and Zenvixas Inc.

We grant you a limited, non-transferable license to access and use our Services.

We may update these Terms at any time. Continued use means you accept any updates.

You may not alter or bypass these Terms (e.g., bookmarking internal pages).

You confirm you are at least 18 years old or of legal age in your location.
2. Prohibited Activities

Violate any laws or Zenvixas policies

Post false or misleading content

Infringe others’ intellectual property

Use bots, scrapers, or harvest data

Spread spam, malware, or harmful content

Circumvent our access restrictions
3. Using the Zenvixas Marketplace
3.1 Posting Items
You may list footwear or accessories by uploading original photos and descriptions.
3.2 Buying & Selling
We facilitate transactions via Zenvixas Payments. Except under our Buyer Protection Policy, we are not a party to these sales.
3.3 Payment Accounts
Use of our payment service requires agreement with our third-party provider (currently Adyen). Identity verification may be required.
3.4 Taxes
You’re responsible for your own taxes. We may collect sales tax where required.
3.5 Shipping
Sellers must follow our Shipping Policy. Zenvixas is not liable for delays or shipping damage.
4. User Conduct
You may not:

Harass or impersonate others

Use crypto or gift cards for payment

Sell prohibited, counterfeit, or dangerous items

Reverse-engineer our platform or services

Operate multiple or shared accounts without permission
Violations may result in account termination.
5–6. Data Collection & Use
We collect both personal and technical data to improve your experience and our services. By using our platform, you consent to this collection and use.
7. Account Security
You are responsible for safeguarding your login credentials. Notify us immediately if your account is compromised.
8. User-Submitted Content
You retain ownership of content you post, but grant Zenvixas a license to use it for providing and promoting our Services.
9. Reporting Abuse
See something inappropriate? Report it to 📧 help@zenvixas.com. We may remove content at our discretion.
10–12. Usage Limits & Anti-Spam

We reserve the right to limit usage or suspend accounts.

No unauthorized third-party posting services.

Spamming users (on or off platform) is strictly prohibited.
13–14. Intellectual Property
All trademarks, content, and technology belong to Zenvixas or our licensors. Do not copy or distribute them without permission.

15–16. No Warranty
Zenvixas is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free service.
17. Risk of Interaction
Meeting other users in person involves risk. Zenvixas does not conduct background checks. Use common sense and caution.
18. Limitation of Liability
We are not liable for indirect damages. Our total liability is capped at:

The amount you paid us in the last 12 months — whichever is greater.
19. Buyer Protection
You may file claims for:

Misrepresentation

Delivery failure

Product defects (within 48 hours of delivery)

20–22. Legal Terms

You release us from disputes between you and other users.

You consent to your data being processed in the U.S. and abroad.

You agree to indemnify us for any claims resulting from your actions on the platform.
23. Arbitration Agreement
Binding Arbitration Required
Disputes must be resolved individually via JAMS arbitration in King County, WA or virtually. No class actions allowed.
You may opt out within 30 days of first use by emailing 📧 support@zenvixas.com.
Claims must be filed within 1 year of the event.
24–26. Termination & Ownership

Zenvixas may suspend or terminate your account at any time.

Unauthorized access is prohibited.

All Zenvixas content remains our property.
27–28. Force Majeure & Relationship
We’re not liable for delays caused by events beyond our control.
These Terms do not create any joint venture, employment, or partnership.
29–31. Security & Privacy
We use industry-standard security protocols. Use of Services confirms agreement with our Privacy Policy.
We may share your information if required by law.
32–33. Business Changes
In case of a merger, sale, or bankruptcy, user data may be transferred. Use of the platform implies consent to such transfers.
34. Feedback & Contributions
Any ideas or suggestions you submit are non-confidential and may be used by Zenvixas without compensation.
35. Entire Agreement
These Terms, plus linked policies (e.g., Privacy, Returns, Shipping), constitute the full agreement between you and Zenvixas. They override all prior communications or understandings.
